Terms of Service

Welcome to BackHome Assist. By requesting, purchasing, or using any of our services, you agree to be bound by these Terms of Service.

1. About BackHome Assist

BackHome Assist provides task coordination, verification, welfare support, property inspection, construction monitoring, document follow-up, and related assistance services across Ghana on behalf of clients residing locally or internationally.

Our role is to act as an independent service provider facilitating agreed tasks. We are not a law firm, financial institution, private investigation company, government agency, healthcare provider, or licensed security service.

2. Service Requests and Acceptance

All service requests are subject to review and acceptance. We reserve the right to decline, suspend, or terminate any request that:

  • Is unlawful or unethical.
  • Creates a safety risk for our staff or third parties.
  • Involves harassment, intimidation, surveillance, or stalking.
  • Requires professional services for which we are not licensed.
  • Falls outside our operational coverage area.
  • Contains inaccurate, misleading, or incomplete information.

A service agreement is formed only when we confirm acceptance of a request and any required payment has been received.

3. Customer Responsibilities

Clients agree to:

  • Provide accurate and complete information.
  • Obtain any permissions, authorisations, or consents required for us to perform the requested task.
  • Respond promptly to requests for clarification.
  • Ensure that any instructions provided are lawful and reasonable.
  • Cooperate with us where access, documentation, or third-party engagement is required.

We are not responsible for delays or failures resulting from incomplete information, inaccurate instructions, or lack of client cooperation.

4. Scope of Services

The scope of each engagement will be agreed upon before work begins. Any additional work requested after commencement may be subject to additional fees and revised timelines. Where circumstances change during a task, we reserve the right to pause work until revised instructions are received and approved.

5. Reporting, Evidence and Documentation

Where appropriate and legally permissible, we may provide written reports, photographs, videos, receipts, site observations, and progress updates. The availability of such evidence may be restricted by privacy laws, property owner restrictions, hospital, school, government, or workplace policies, security requirements, or safety considerations. BackHome Assist does not guarantee the availability of photographic or video evidence in every engagement.

6. Construction Monitoring and Property Inspections

Our inspections and monitoring services are observational only. Unless expressly agreed in writing, we do not provide engineering certifications, structural surveys, or architectural assessments, and we do not guarantee workmanship, materials, contractor performance, or project outcomes. Clients remain responsible for obtaining professional engineering, architectural, legal, or surveying advice where required.

7. Welfare Visits

Welfare visits are conducted to provide factual observations based on the circumstances observed at the time of the visit. We do not provide medical assessments or mental health evaluations, and we do not guarantee the safety, wellbeing, or future condition of any individual. We are not a substitute for emergency services, healthcare providers, or social care professionals. If we identify an immediate risk to health or safety, we reserve the right to contact appropriate local authorities or emergency services where reasonably necessary.

8. Fees and Payment

Fees will be communicated and agreed prior to commencement of work. Charges may include service fees, transportation costs, accommodation expenses where applicable, government or third-party charges, and emergency or expedited service fees. All payments are non-refundable once work has commenced, except where otherwise required by applicable law.

9. Delays and Force Majeure

We shall not be liable for delays or inability to perform services resulting from circumstances beyond our reasonable control, including government actions, civil unrest, weather events, road closures, public health emergencies, utility failures, transportation disruptions, or actions or omissions of third parties.

10. Privacy and Confidentiality

We are committed to protecting client information. Information provided to us will be handled in accordance with our Privacy Policy and applicable data protection laws. We will only share client information where necessary to perform the requested service, required by law, required to protect the safety of individuals, or authorised by the client.

11. Intellectual Property

All reports, photographs, videos, written summaries, templates, and materials produced by BackHome Assist remain our intellectual property unless otherwise agreed in writing. Clients may use delivered reports and materials for personal, family, or business purposes related to the requested service.

12. Limitation of Liability

To the maximum extent permitted by law, BackHome Assist shall not be liable for indirect or consequential losses, loss of profits or business opportunities, decisions made by clients based on information provided, actions or omissions of third parties, government decisions or administrative delays, construction defects or contractor performance, or outcomes beyond the agreed service scope. Our total liability arising from any service shall not exceed the amount paid by the client for the specific service giving rise to the claim.

13. Indemnity

You agree to indemnify and hold harmless BackHome Assist, its directors, employees, contractors, and representatives from any claims, liabilities, losses, damages, or expenses arising from your breach of these Terms, false or misleading information provided by you, unlawful instructions or requests, or any third-party claim arising from your use of our services.

14. Termination

We reserve the right to terminate or suspend services at any time where these Terms are breached, safety concerns arise, payment obligations are not met, or continuing the engagement would be unlawful or unreasonable. Any work completed prior to termination remains payable.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
